July 1, 2007, the state legislature enacted laws aimed at relieving the
clogged court system. This new legislation requires those involved in
Florida condominium and homeowners' association (HOA) disputes to undertake mandatory mediation as an initial method of resolving their conflict.

Mediation,
a form of alternative dispute resolution (ADR), is a confidential
process designed to enable parties to resolve their differences through
discussion and cooperative problem solving. It offers many benefits to
participants, such as:
Eliminating the risk of letting a judge or jury decide the outcome
Permitting the parties to negotiate a settlement with mutually acceptable terms
Allowing
parties to resolve disputes in a timely manner, as opposed to the
months or even years (including appeals) that litigation may require.
