South Florida Condominium and Homeowners' Association Mediation

Association Mediation In response to the steady rise in legal disputes involving homeowners' associations (HOAs), the State of Florida (as of July 1, 2007) now requires all parties to these disputes to undertake mediation before filing a lawsuit and/or arbitration proceedings. In addition, the Florida condominium statute allows arbitrators to require mediation in disputes between the association and its owners and Florida Circuit and County Court judges require mediation of these disputes before allowing them to proceed to trial.

One aim of mediation, a form of alternative dispute resolution (ADR), is to reduce congestion in the state courts of Florida. In addition, at Association Mediation, Inc., we also know from experience that mediation is less costly, less time-consuming, and altogether less combative than going to court. Other advantages of non-binding mediation include:

  • It is a confidential process.
  • It removes the speculation of what a judge or jury might do
  • It can facilitate constructive dialogue
  • It still gives parties the chance to take their dispute to court if negotiations break down
