In response to the steady rise in legal disputes involving homeowners'
associations (HOAs), the State of Florida (as of July 1, 2007) now
requires all parties to these disputes to undertake mediation before
filing a lawsuit and/or arbitration proceedings. In addition, the
Florida condominium statute allows arbitrators to require mediation in
disputes between the association and its owners and Florida Circuit and
County Court judges require mediation of these disputes before allowing
them to proceed to trial.
